SMS Messaging Policy and Terms of Service

This SMS Messaging Terms of Service (“Agreement”) is entered into by and between AVI Career Training (“AVI,” “we,” “our,” or “us”) and individuals or entities using AVI Career Training’s SMS communication services (“Users,” “Students,” or “Recipients”).

AVI Career Training utilizes Twilio’s messaging platform to send and receive SMS communications. This Agreement outlines the rules, responsibilities, and conditions related to the use of AVI Career Training’s SMS messaging services (the “Service”).

By accessing or using this Service, you acknowledge that you have read, understood, and agreed to comply with the terms stated in this Agreement. If you do not agree with these terms, you should not use AVI Career Training’s SMS messaging services.


1. Description of the Service

The Service allows AVI Career Training to send and receive SMS text messages with students, prospective students, clients, and other individuals who have provided consent to receive communications from AVI Career Training.

Messages may include information such as:

  • Admissions updates
  • Appointment reminders
  • Student services notifications
  • School announcements
  • Administrative communications

The Service operates using Twilio’s communication infrastructure and is provided on an “as available” and “as is” basis. AVI Career Training does not guarantee uninterrupted availability, accuracy, or reliability of SMS messaging services.


2. Use of the Service by AVI Career Training

2.1 Compliance with Laws

AVI Career Training agrees to use SMS communications in accordance with all applicable laws and regulations, including telecommunications regulations, privacy laws, and consumer protection laws.

2.2 Prohibited Uses

SMS messaging through AVI Career Training will not be used for unlawful, abusive, or deceptive activities. Prohibited activities include:

  • Sending unsolicited messages without proper consent.
  • Sending unlawful, threatening, harassing, or offensive content.
  • Misrepresenting the identity of AVI Career Training or impersonating another entity.
  • Transmitting malicious software or harmful links.
  • Interfering with messaging systems or communication networks.
  • Attempting to gain unauthorized access to systems or messaging platforms.

2.3 Consent to Communicate

AVI Career Training sends SMS messages only to individuals who have provided their mobile number and consent to receive communications. Consent may be obtained through:

  • Enrollment forms
  • Website contact forms
  • Student registration processes
  • Written authorization
  • Direct opt-in methods

AVI Career Training maintains appropriate records of consent.

2.4 Opt-Out Rights

Recipients may stop receiving SMS communications at any time. If a recipient replies with “STOP”, the mobile number will be removed from the messaging list and no further messages will be sent unless consent is re-established.

2.5 Protection of Personal Information

AVI Career Training respects the privacy of individuals receiving SMS messages.

  • Mobile numbers are used only for school-related communications.
  • Numbers are not sold or shared with third parties for marketing purposes.
  • Information is protected in accordance with applicable privacy laws.

Information may only be disclosed when required by law or regulatory authorities.

2.6 Message Frequency

Message frequency may vary depending on the nature of the communication.

  • Message volume generally will not exceed 100 one-way messages per day.
  • Two-way communications may exceed this limit when users initiate conversations.

AVI Career Training reserves the right to adjust messaging frequency when necessary for service delivery.

2.7 Message and Data Charges

Standard message and data rates may apply to SMS messages sent or received through AVI Career Training’s messaging services.

These charges are determined by the recipient’s mobile carrier. AVI Career Training is not responsible for these charges.

2.8 Twilio Platform Usage

AVI Career Training uses Twilio as the communication platform that powers its SMS messaging services. Message delivery and routing are provided through Twilio’s infrastructure and may be subject to Twilio’s technical and operational policies.


3. SMS Message Recipients

3.1 Consent to Receive Messages

By providing a mobile phone number to AVI Career Training, recipients consent to receive SMS communications regarding school services, educational programs, administrative updates, or related communications.

3.2 Message Frequency

The number of SMS messages may vary depending on the services being used but will generally not exceed 100 outgoing messages per day.

3.3 Carrier Charges

Recipients acknowledge that standard carrier messaging rates may apply. These charges are billed directly by the mobile service provider.

3.4 Opt-Out Process

Recipients may opt out at any time by:

  • Replying STOP to any SMS message
  • Contacting AVI Career Training to request removal from SMS communications

Opting out may affect the ability to receive certain service-related updates.


4. Intellectual Property

All messaging systems and technical infrastructure used to deliver SMS communications remain the property of their respective providers. AVI Career Training retains ownership of its content and communications transmitted through the Service.


5. Limitation of Liability

AVI Career Training shall not be responsible for indirect or consequential damages resulting from delayed delivery, service interruptions, network outages, or technical failures associated with SMS messaging services.


6. Indemnification

Users agree to hold AVI Career Training harmless from any claims, damages, or liabilities arising from misuse of the messaging service or violation of applicable laws.


7. Suspension or Termination of Service

AVI Career Training reserves the right to suspend or terminate SMS communication services if:

  • The terms of this Agreement are violated
  • Messaging services are misused
  • Required system requirements are not met
  • Legal or regulatory compliance requires termination

8. General Provisions

8.1 Entire Agreement

This Agreement represents the complete understanding between AVI Career Training and SMS service users.

8.2 Changes to Terms

AVI Career Training may update these terms at any time. Continued use of the Service constitutes acceptance of the updated terms.

8.3 Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia.

8.4 Severability

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in effect.


9. Refund Policy

All fees related to SMS messaging services including messaging credits, setup fees, or platform fees are non-refundable.

AVI Career Training does not provide refunds for unused messaging balances or unused services.


10. Non-Payment and Phone Number Risk

Failure to maintain required payments for SMS messaging services may result in suspension of messaging services.

In certain situations, non-payment may result in the loss or reassignment of phone numbers associated with the messaging service.

AVI Career Training is not responsible for losses resulting from such circumstances.


By using AVI Career Training’s SMS messaging services, users confirm that they have read, understood, and accepted these terms.
